RetirePath Virginia: does your business have to register, and by when?
Since July 1, 2026, Virginia's rule covers employers with five or more eligible employees that don't offer a qualified retirement plan. They have to register with RetirePath Virginia or offer their own plan.
The next deadline is October 30, 2026, for newly eligible in 2026, 5 to 9 or 25 or more employees.
Newly eligible businesses get a deadline by size. If you already offer a 401(k), you certify an exemption instead.
Who has to do this?
Under Virginia's state-facilitated IRA law (Va. Code §§ 2.2-2744 to 2.2-2752, as amended by 2026 Acts chapters 84 and 85, in effect from July 1, 2026)5, a Virginia employer is covered when all of these are true:
- You employed five or more eligible employees for the period ending December 31 of the previous year. 3
- You don't sponsor a qualified retirement plan, such as a 401(k), 403(b), SEP or SIMPLE IRA. 3
The program's site also says a business must have been operating for two or more years. The 2026 change to the law removed that test from the statute, so if your business is newer, check with RetirePath. 1
What a covered employer does: Register with RetirePath Virginia and send eligible employees' payroll deductions, or certify an exemption. 1
When?
The next deadline is October 30, 2026, for newly eligible in 2026, 5 to 9 or 25 or more employees.
| Who | Deadline | What is due |
|---|---|---|
| Employers eligible before 2026 | Has passed | Register or certify an exemption 1 |
| Newly eligible in 2026, 10 to 24 employees | September 30, 2026Passed | Register or certify an exemption 1 |
| Newly eligible in 2026, 5 to 9 or 25 or more employees | October 30, 2026 | Register or certify an exemption 1 |
A business becomes eligible whenever it meets the test. RetirePath notifies eligible employers when it's time to register, and the notice gives the deadline. 1
